Welcome to Ayekoo Afrique! We are excited to have you join our community on a journey to connect with the languages and cultures of Africa.
These Terms of Service (“Terms”) govern your use of the Ayekoo Afrique website, platform, and services (collectively, the “Services”). By creating an account, purchasing, or participating in any of our lessons or events, you agree to these Terms. Please read them carefully.
1. Description of Service
Ayekoo Afrique provides an online platform that connects students (“Students,” “you”) with independent language tutors (“Tutors”) for the purpose of learning African languages and cultures. Our services include:
- Private 1-on-1 Lessons: Personalized online tutoring sessions.
- The Aekoo Hub: Group lessons, cultural workshops, and community events.
- Platform Tools: Including a student dashboard for managing your schedule, a messaging system for communicating with Tutors, and various engagement features.
Ayekoo Afrique acts as a facilitator to help you connect with Tutors. The Tutors are independent contractors and not employees of Ayekoo Afrique.
2. User Accounts & Responsibilities
- Account Creation: To access most features, you must register for an account. When you book your first lesson, an account will be created for you. You are responsible for providing accurate and up-to-date information.
- Password Security: You will be sent a link to set your password upon account creation. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
- Your Profile: You have the ability to update your personal information, including your name, bio, and learning goals, in your “My Profile” section. You agree that this information will be accurate and respectful.
3. Payments, Cancellations, and Refunds
- Payments: All payments for lessons, lesson packages, and events must be made through our secure online booking system at the time of purchase. Prices are listed in USD and are subject to change.
- Lesson Packages: Lesson packages are purchased in advance and credits are added to your account. These credits can be used to book individual lessons with Tutors. Lesson credits are valid for 12 months from the date of purchase.
- Cancellations & Rescheduling: We understand that schedules can change. Our cancellation and rescheduling policy is as follows:
- More than 24 hours notice: You may cancel or reschedule your lesson without penalty through your student dashboard.
- Less than 24 hours notice: Cancellations made with less than 24 hours notice, or failure to attend a scheduled lesson (a “no-show”), will result in the full cost of the lesson being charged or one lesson credit being forfeited.
- This policy is in place to respect the time and commitment of our Tutors.
- Refunds: Payments for individual lessons and lesson packages are generally non-refundable. If you believe you have been charged in error or have extenuating circumstances, please contact our support team.
4. Code of Conduct
Ayekoo Afrique is a community built on respect. By using our Services, you agree to:
- Communicate Respectfully: Interact with Tutors and fellow students in a courteous and professional manner at all times, including within our messaging system.
- Prohibited Content: Do not share any content that is unlawful, harassing, defamatory, abusive, or otherwise objectionable.
- Platform Integrity: Do not attempt to circumvent our platform by arranging private lessons or payments with Tutors outside of the Ayekoo Afrique system.
Violation of this Code of Conduct may result in a warning, suspension, or permanent termination of your account, at our sole discretion.
5. Gamification System (XP & Badges)
Our platform includes engagement features such as Experience Points (XP), Badges, and Challenges.
- These features are designed to enhance your learning experience and are provided for motivational purposes.
- XP, Badges, and other virtual rewards have no cash value and cannot be redeemed or transferred.
- Ayekoo Afrique reserves the right to modify, add, or remove features of the gamification system at any time.
6. Intellectual Property
- Our Content: All content provided by Ayekoo Afrique, including our curriculum, website design, and branding, is the exclusive property of Ayekoo Afrique. You may not use, reproduce, or distribute any of this content without our express written permission.
- Tutor Content: Any materials provided to you by a Tutor remain the intellectual property of that Tutor. These materials are for your personal educational use only.
7. Account Termination
- Termination by You: You may request to terminate your account at any time by contacting our support team. Please note that termination will result in the forfeiture of any remaining lesson credits.
- Termination by Us: Ayekoo Afrique reserves the right to suspend or terminate your account if you violate these Terms, engage in any activity that is harmful to our community or business, or for any other reason at our sole discretion.
8. Disclaimers and Limitation of Liability
- The Services are provided on an “as is” and “as available” basis. While we strive to provide a high-quality experience, we make no warranties that the Services will be uninterrupted, error-free, or completely secure.
- Ayekoo Afrique is not responsible for the conduct, whether online or offline, of any user of the Service. You are solely responsible for your interactions with other users.
- To the fullest extent permitted by law, Ayekoo Afrique shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services.
9. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of New Mexico/ USA, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in New Mexico/ USA, rather than in court.
10. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you through the platform or by email. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
